Vādanyāya is one of the representative works of Dharmakīrti. It is concerned with debate logic and deals with win-or-lose reasoning rules in the broad sense of logic. In this paper, we will concentrate our discussion on Dharmakīrti’s theory of nigrahasthāna (fault) in his debate logic, a key issue in Vādanyāya. First, we point out that the justification of three logical reasons as proof conditions of debate constitutes the rational point of departure for Dharmakīrti’s debate logic. Second, we analyze the differences (...) between Dharmakīrti’s and the Naiyāyika’s notion of debate and point out that Dharmakīrti’s ‘debate’ involves two parties (the disputant and the opponent) attempting to rationally refute the other’s opinion to persuade the other to change their wrong ideas. Last, based on the discussion of Dharmakīrti’s concept of debate logic, we identify seven types of nigrahasthāna in Vādanyāya with regard to the two parties of a debate (the disputant and the opponent). This paper sketches the antilogism of Christine Ladd-Franklin and historical advancement about antilogism, mainly constructs an axiomatic system Atl based on first-order logic with equality and the wholly-exclusion and not-wholly-exclusion relations abstracted from the algebra of Ladd-Franklin, with soundness and completeness of Atl proved, providing a simple and convenient tool on syllogistic reasoning. Atl depicts the empty class and the whole class differently from normal set theories, e.g. ZFC, revealing another perspective on sets and set theories. Two series of Dotterer (...) and the theorem proved by Russinoff are re-characterized in antilogistic formulas corresponding to the square of opposition and twenty-four moods of syllogism. Then the restricted equivalence between two forms of antilogism and minimal inconsistency is built up, implying the internal connection between antilogisms and minimal inconsistency and leaving two related conjectures not proved. Besides, this paper provides a new explanation for the reason why contrariety, subcontrariety, and subalternation and the nine special moods require the non-empty assumption. (shrink)

Despite the growing number of studies on the topic of guanxi in a work context, there is a paucity of research on supervisor-subordinate guanxi in the field of organisation and management. This article critically reviews the extant literature on guanxi in human resource management and organisational behaviour and applies an inductive approach to explore the perception of guanxi from both superior and subordinate perspectives in the People's Republic of China. The study reports positive and ethical features of guanxi as (...) well as unethical and negative practices in the Chinese workplace. On the positive side, guanxi comprises reciprocal exchange and perceived positive attributes, whereas its darker aspects include perceived unfairness and supervisor-targeted impression management. This paper reports the first case in which a linguist served as an expert witness in Hong Kong, a former British colony that has operated as a special administrative region of the People’s Republic of China (PRC) since 1997. The dispute was on the meaning of the political slogan “Liberate Hong Kong, Revolution of Our Times”, which was widely adopted during the 2019–2020 protests. The keywords “liberate” and “revolution” are smoking gun evidence for the prosecution in a large cluster (...) of cases that involve sedition law and national security offences. Section I of the paper provides background information about a case the author was involved in, which was concerned with whether the slogan was seditious. Section II describes the analysis conducted, which concludes that the slogan as a whole refers to a need to rectify a problem and to return to the original, a more desirable state of affairs for Hong Kong, without specifying what problem there is and what the desirable state of affairs looks like. Section III highlights some critical issues in the analysis, discussing challenges faced and ethical questions for the expert witness. The article deals with linguistic relativism in the decisions of the Austrian Verfassungsgerichtshof and the Czech Constitutional Court. It focuses on the Courts argumentation in which the state of language and its limiting perception of the word gender about non-binary and intersex people were used. The article conducts an in-depth analysis of two judgments. The first is the ruling of the Constitutional Court of the Czech Republic Case No. Pl. ÚS 2/20, in which the Court argued the absence of (...) gender-neutral names in Czech as one of the reasons for rejecting the constitutional complaint. The second is the judgment of the Austrian Verfassungsgerichtshof Case No. G 77/2018-9, in which the Court concluded as part of the constitutional review that the language can be adapted to the societal situation. The paper analyses selected parts of both decisions, interpreted using fundamental theses of linguistic relativism (and determinism). I argue that the Czech Constitutional Court has adopted a conservative approach without considering the current societal situation. This opened space for the unequal status of people with an alternative gender identity in society based on ignoring inclusive language, which is the exact opposite of the position of the Austrian Verfassungsgerichtshof. The notion of moral exemplarity, though repeatedly alluded to in John Stuart Mill’s writings, is rarely treated as an essential element of his democratic theory. This article, however, highlights and explains the centrality of exemplarity in Mill’s project of fostering public-minded citizens for a successful democracy. In Representative Government, Mill conceives the exemplary influence of deliberative elites as a necessary condition for making local deliberative bodies the main site for the cultivation of a public spirit. Mill’s Romantic reading of Plato’s (...) Gorgias suggests that this move resulted from his radical skepticism about the power of reason to motivate virtuous behavior along with his corresponding faith in the moral exemplar’s aesthetic force of beauty to improve the spectator’s conduct. Mill’s emphasis on the necessity of exemplary influence for achieving a civic ideal based on a detailed account of its moral psychology reveals him to be a unique political thinker who continues to invite contemporary interest. In July 1993, the Scottish Highlands Centre for Human Caring sponsored a conference with the title Exploring the Spirituality in Caring. The papers given at the conference and included in this volume are offered as a contribution to the debate that must take place in nursing and in the wider context of health care provision. Human cognition affects the result of symbolic activity. Evidentiality is a linguistic concept which encodes the source of information and expresses the attitude and confidence of speaker. This paper collects 31 judgments from the Supreme People’s Court (SPC) and local people’s courts in the People’s Republic of China (P.R.C) as the research corpus, and analyzes the evidentiality in four aspects: information source, lingual form, evidential function and speaker’s attitude of the information. It is found in this study that: 1) (...) The information sources are divided into four types as cultural belief, sensory experience, verbal rumor and inferential hypothesis; 2) Lingual form consists of three categories: vocabulary, phrase and compound sentence; 3) Evidentiality in court judgments performs four functions: support with citation, induction with description, paraphrase with less responsibility and summarization with reasoning; 4) The reliability of evidentiality presents a two-tier structure based on different information sources. Disruptions in theory of mind faculties and the ability to relate to an intersubjective reality are widely thought to be crucial to schizophrenic symptomology. This paper applies a cognitive linguistic framework to analyze spontaneous perspective-taking in two corpora of stories told by people with a schizophrenia diagnosis. We elicited natural narrative language use through life story interviews and a guided storytelling task and analyzed the linguistic construal of viewpoint in these stories. For this analysis, we developed a reliable and widely (...) applicable viewpoint model that allows for the categorization and quantification of speakers’ linguistic presentation and navigation of spatiotemporal domains. We found that our participants skillfully presented, navigated and embedded different narrative viewpoints through a variety of linguistic viewpoint devices. They presented complex viewpoints of other people in both the here-and-now of the interaction and the there-and-then of a narrative, and made use of transition markers to demarcate spatiotemporal discourse domains. We found no differences in viewpoint variables when comparing their guided stories to a control group. If problems with intersubjectivity are indeed an essential part of schizophrenia, an explanation of how this group can take on and navigate complex linguistic viewpoints in natural narrative interaction is called for. The main subject of the article is a comparative analysis of the cultures of political relations between the Soviet Union (USSR) and the People's Republic of China (PRC) in the middle of the twentieth century. The author examines in detail such aspects of the topic as ideologization and authoritarianism, centralization of power, control over society and the phenomena of political cults. The article analyzes the key principles and values underlying the political systems of both countries, as well as the (...) strategic goals and methodologies used to implement them. The author explores how ideological principles, power hierarchies and nuances of the political process influenced the formation of civic consciousness and behavioral paradigms of citizens. The article also examines the historical, cultural and geopolitical determinants that determine the similarities and differences in the political cultures of the USSR and the People's Republic of China, and their impact on the domestic and foreign policies of these states. The research methodology includes a comparative analysis of historical sources and scientific works devoted to the political cultures of the USSR and the People's Republic of China, with an emphasis on the study of ideological, structural and socio-political aspects that shaped their development. The scientific novelty of the article lies in a comprehensive comparative analysis of the cultures of the political relations between the USSR and the People's Republic of China, which reveals both common features and unique features of each of them. For the first time, detailed parallels and differences between the two countries are considered in the context of ideologization, centralization of power and mechanisms of control over society. The findings of the study show that despite the common communist heritage, the political cultures of the USSR and the People's Republic of China developed along different trajectories due to national characteristics, historical events and internal political processes. The author argues that these differences have had a significant impact on the international positions and domestic policies of States. As a result, the article contributes to a deeper understanding of the processes of formation and evolution of the political systems of communist regimes, which is important for historians and political scientists studying the history and politics of socialist countries. While many studies have investigated the ethical perceptions, ideologies and value systems of the Chinese, few studies have focused on mainland China, and even fewer have examined regional differences within China. This study examines the factor structure of Forsyth's (1980) Ethics Position Questionnaire in a sample of managers from the PRC. According to Forsyth, individual differences in Relativism and Idealism influence judgements of moral issues (Forsyth, 1980). In a sample of 115 managers, results show that two similar constructs to those (...) described by Forsyth do exist in the Chinese sample. However the precise interpretation of the item groupings through a Chinese perspective, may reveal some discrete areas of difference in the labelling of these constructs. The study also finds that managers in the South of China scored significantly higher in Idealism than managers in the North. Results are presented and implications for future research are discussed. Michurinist biology was introduced to China in 1948; granted a state supported monopoly in 1952; and reduced to parity with western genetics from 1956. The Soviets exported it through the propaganda agencies Sino Soviet Friendship Association and VOKS. China’s Ministry of Agriculture achieved broad public awareness and acceptance of Michurinist biology through a translation, publication, and Soviet guest speakers campaign – all managed by a team of agriculturalists led by Luo Tianyu, a veteran CCP cadre. The campaign grew exponentially, but (...) did not affect university or Chinese Academy of Sciences biology. Luo Tianyu’s failed attempt to force Michurinist biology on a Beijing university triggered its second stage: monopoly status and a ban on “Mendelist-Morganist” biology in teaching, research, and publication. The CCP Central Committee supported this policy believing that Michurinst biology would increase agricultural production for the forthcoming first Five Year Plan; whereas, western genetics had no practical value. Michurinist biology flourished at all levels of education, research, and science literature; Western genetics was completely shut down. This only began to change when the CCP Central Committee became wary of China’s dependency on Soviet technical expertise and failure to fully utilize that of China. Change was further promoted by significant attacks on Michurinist biology by Soviet and East German biologists. Soon, these developments informed China’s “genetics question,” which became a test case for larger questions about the definition of science and the relationship between scientists and the state. Under the guidance of Lu Dingyi’s Central Committee Propaganda Department, the CCP eventually decided that, henceforth, science controversies would only be resolved by the science community; and that monopolies or ideological orthodoxies would not be imposed on science. At the same time, the CCP rescinded Michurinist biology’s monopoly and the ban on western genetics. By the mid-1960s western genetics had successfully restored itself, largely due to the leadership of C. C. Tan, a former student of Dobzhansky. Almost fifty minorities coexist in the country in addition to the majority Han people. Tension and conflict are inevitable as diverse—and sometimes incompatible—values come to the fore at this historic juncture. Many fields, including medicine, face new challenges, and in this environment the field of bioethics is flourishing.Like many countries, China is groping with the effects of new medical technology and skyrocketing health care costs. But in the context of the Chinese sociocultural environment, some unique—as well as more familiar—issues arise. None of the classic texts provide ready-made answers to these dilemmas; we must find the answers ourselves. The only reasonable way to resolve the conflicts between opposing values is through dialogue, consultation, and negotiation among the various social and cultural groups.The bioethical dilemmas receiving the most attention in China now relate to the two ends of life: birth and death. On one end are issues relating to reproductive technology, especially birth control and family planning; at the other end is euthanasia.Dilemmas Surrounding Reproductive TechnologyAccording to traditional Chinese belief, not having a child results from not having virtue. In fact, the most serious violation of the Confucian [End Page 16]principle of filial piety is to be without offspring. A Chinese man without a child experiences heavy psychological pressure, and the burden is especially onerous for women because infertility is always blamed on the wife. Wives who do not bear a child are stigmatized and mistreated—even abused—in families that stick to traditional values.In China today, this widely held belief is colliding with another reality: an apparent increase in infertility among newly-married couples. The rate may be about 5 percent. These couples turn to doctors for help.Artificial insemination by donor (AID) and by husband is now widely practiced. Eleven provinces have established sperm banks, and private doctors are performing AID for considerable fees. But procedures to address legal and ethical problems associated with the procedure have lagged behind. With the exception of a few centers in large cities, AID is undertaken without established procedures or policies relating to the selection of donors and recipients, records about those involved, or clarification of the status of the child. The legal status of the child remains unresolved.The status of the child within the community is also unresolved as traditional values clash with the application of modern technology to childbearing. An infertile couple enters into a contract with a woman who has intercourse with the husband in order to bear a child for the couple. This practice is called "borrowing a wife." H. Brann; xviii & 249 pp. Lanham, Md.: Rowman & Littlefield Publishers, 2001, $35.00. This, the third of Eva Brann's trilogy on imagination, time, and naysaying respectively, is described by one of her colleagues as her (...) "cradle-to-grave book" (p. xvi). The word "naysaying" plays felicitously on the sound of the English word "nay" and the cognate Indo-European root "ne," which gives Brann a convenient starting-point for discerning what various forms of naysaying have in common. Note that this is saying rather than thinking, being, or doing, although the relations among these acts are a recurring concern in her discussion. Unlike some "postmoderns," Brann does not regard language as a self-contained arena with no reference outside of itself. Rather, for her, language is a convenient medium for thinking about what is extralinguistic, whether in the mind or elsewhere.Nor does she think that a word must necessarily have some underlying unity beneath its various meanings. In fact, heeding Wittgenstein's warning, she admits that "it is a pathologically bad craving to want a word to have one ultimate meaning, worse to look for one meaning over many words, and worst to assume that such a meaning may apply to a something beyond the realm of language." The relevance of this study consists in the entire society’s strong awareness of the need for gender equality, not only in a practical sense but also at the level of communicative culture. This culture strongly influences people’s self-awareness and often determines their role in everyday life, depending on the attitude inherent in the lexical units that are applied to an individual. The purpose of the study is the most complete consideration of the specific features of gender stereotype functioning and (...) development in the Kazakh language in different aspects, the identification of types of gender vocabulary, and consideration of the historical and cultural context of the development and functioning of a gender stereotype in the Kazakh language. Both linguistic and historical methods were used, which allowed for considering the communicative culture of the Kazakh language not only in modern realities but also in a historical context. As a result of the study, the phraseologisms of the Kazakh language, including gender stereotypes, were considered, and the features of gender stereotype development in the historical context were considered. As a result of the study, a conclusion was made about the specific features of the development and functioning of the gender stereotype in the Kazakh language, its spread in the communicative culture of the Republic of Kazakhstan, the influence on the perception of individuals due to the use of gender-coloured lexical units in their address, and the definition of gender stereotypes of “masculinity” and “femininity” was made, which allowed for a more accurate classification of the gender-coloured group of lexical units in the Kazakh language. Introduction. The relevance of the research topic is determined by the necessity to study financial phenomena and processes in order to understand the economic essence of public finance in the life of society. The strategic imperative for the formation of public finance is the development of an appropriate provision for its implementation, adequate to the complex and changeable circumstances of the territory development. The main purpose of the study is to identify the features of performing the functions of public finance (...) for regions with a specific mode of operating. Methods. When solving the tasks, the author uses general logical methods: analysis, synthesis, induction, deduction, analogy; empirical level methods: observation, description, measurement, modeling, as well as private and special methods of scientific research: comparative analysis, system approach, the Robinsonade model (Crusoe model). Scientific novelty of the research. The scientific novelty of the results lies in solving an important scientific problem - identifying the features of implementing the allocative function of public finance in the regions with a specific mode of operating (as exemplified by the Donetsk People’s Republic, where there is a special military and political situation, a mobilization type of economy, a transitional period due to the integration of the Republic into the system of the Russian Federation federal relations) in order to improve the system of public finance management in such regions. Results. The main results of the study consist in characterizing the process of implementing the allocation function of public finance, which makes it possible to determine the maximum effect of economic actions of the subjects in the current conditions, as well as to lay the foundations for analyzing the following distribution function of public finance. Conclusions. The author makes a conclusion that in the context of strengthening the role of public finance, not only in ensuring the economic development of the Donetsk People’s Republic, but also in the post-crisis recovery and stabilization of business activity, the implementation of the allocation function of public finance becomes important. During the Communist regime, after Poland was officially proclaimed the People’s Republic of Poland, the aim of the Polish Communist government was to control all aspects of society. Communist ideals were enforced in books and other publications; censorship was introduced on all published materials. This paper aims to present the situation of media in People’s Poland, as well as to provide a background and description of Polish censorship. Additionally, this paper will exposit and examine the socio-political role of Tygodnik (...) Powszechny in Polish society. As TP is a Catholic weekly, an outline of the unique socio-political role of the Polish Roman Catholic Church in communist Poland will accompany the above analysis. This paper is based on the research conducted by the author in partial fulfillment of the requirements for the Master of Arts degree written and defended at the Central European University in Budapest in 2012. Recent scholarship on the philosophy of time in pre-Qin Daoist thought has not yet produced a thorough examination of dao’s relationship to time. This essay resolves this omission through a systematic study of the concept heng 恒 in pre-Qin Daoist literature. While principally expressing the ‘constancy’ of dao, heng also significantly presupposes dao’s ability to change. This change is characterized in the texts as a cyclical movement of ‘return’ and identified with the universe’s circular metanarrative of generation and reintegration. The (...) essay turns to examine pre-Qin Daoist literature’s use of primal wu 無 metaphors to describe dao. It concludes that they present dao as undifferentiated infinitude, liberating dao as heng from the tense structure of past-present-future that divides life in time. These metaphors further associate the movement of dao with the flow of time, reformulating time’s relentless ever-greater advancement into an endless cycle of creative transformation. (shrink)

A decision-tree model of an indigenous forest management system centered around shamu (Cunninghamia lanceolata),an important timber species in China, was constructed from extensive interviews with peasants in two villages in Fujian Province, China. From this model additional interviews were conducted to elicit from these peasants their reasons for selecting among decision alternatives. Those reasons that were of an ecological nature were discussed in detail with the peasants to elicit indigenous interpretations of ecological processes in order to test an hypothesis that (...) a strong analogy exists between traditional indigenous and scientific knowledge of ecological processes.Three cases are presented that test this hypothesis. These three cases concern the effect of intercrops on the growth of shamu,the relative merits of seedlings and root collar sprout cuttings for forest regeneration, and the effects of repeated plantings of shamuon soil chemistry. All three cases provide strong support for the research hypothesis and suggest that, even in the absence of a formalized scientific method, humans exercise mental processes typical of scientific thinking. In China, there have been numerous reports that doctors or other health care workers have been attacked by patients or members of patient’s families. From 2000 to 2003, there were 502 reports of violence against health care workers in the city of Beijing, in which 90 health care workers were wounded or disabled. From January 1991 to July 2001, in Hubei Province, 568 attacks on health care facilities and workers were reported, and some health care workers were even killed. In (...) Jiangsu Province, from 2000 to 2002, violent events against health care facilities and workers increased by 35% every year, with an average of 177 such events occurring each year. Those acts of violence have been attributed, in part, to the inadequacy of the legal system for handling medical disputes that was in effect prior to 2002. (shrink)

Background: People with a personality disorder suffer from enduring inflexible patterns in cognitions and emotions, leading to significant subjective distress, affecting both self and interpersonal functioning. In clinical practice, Dance Movement Therapy is provided to clients with a PD, and although research continuously confirms the value of DMT for many populations, to date, there is very limited information available on DMT and PD. For this study, a systematic literature review on DMT and PD was conducted to identify the content of (...) the described DMT interventions and the main treatment themes to focus upon in DMT for PD.Methods: A systematic search was conducted across the following databases: EMBASE, MEDLINE, PubMed, WEB OF SCIENCE, PsycINFO/OVID, and SCOPUS following the PRISMA guidelines. The Critical Appraisal Skills Programme for qualitative studies was used to rank the quality of the articles. The Oxford Center for Evidence-based Medicine standards were applied to determine the hierarchical level of best evidence. Quantitative content analysis was used to identify the intervention components: intended therapeutic goals, therapeutic activities leading to these goals, and suggested therapeutic effects following from these activities. A thematic synthesis approach was applied to analyze and formulate overarching themes.Results: Among 421 extracted articles, four expert opinions met the inclusion criteria. Six overarching themes were found for DMT interventions for PD: self-regulation, interpersonal relationships, integration of self, processing experiences, cognition, and expression and symbolization in movement/dance. No systematic descriptions of DMT interventions for PD were identified. A full series of intervention components could be synthesized for the themes of self-regulation, interpersonal relationships, and cognition. The use of body-oriented approaches and cognitive strategies was in favor of dance-informed approaches.Conclusions: Dance movement therapists working with PD clients focus in their interventions on body-related experiences, non-verbal interpersonal relationships, and to a lesser extent, cognitive functioning. A methodological line for all intervention components was synthesized for the themes of self-regulation, interpersonal relationships, and cognition, of importance for developing systematic intervention descriptions. Future research could focus on practitioners' expertise in applying DMT interventions for PD to develop systematic intervention descriptions and explore the suitability of the identified themes for clinical application. Clients' experiences could offer essential insights on how DMT interventions could address PD pathology and specific PD categories. (shrink)

Battles against domestic violence in the People’s Republic of China have been carried out since 1995. In this study, legislative progression of laws related to domestic violence is first examined and clarified; second, findings from the legislative review are investigated on the basis of civil and criminal cases; third, the interaction among social and traditional norms, legislation, and judicial outcomes is explored and interpreted from a sociosemiotic perspective. It is found in this study that: 1) legislation and judicial practices (...) of domestic violence in the P. R. C. are closely intertwined with social and traditional norms; 2) there is a gap between judicial practices dealing with domestic violence and the legislation; 3) the Anti-Domestic Violence Law offers a notch for state powers to embrace the familial relationship and to safeguard a victim. The aim of the article is to analyze the relationship between Singapore and the People’s Republic of China in the light of the current policy of the President of the United States Donald Trump. The point of reference for the presented analysis is the foreign policy of the former President Barack Obama, based on the strategy known as “pivot to Asia” – the strategic turnabout of the United States to the Asia-Pacific region. One of its main objectives was the (...) signing of a multilateral agreement on the establishment of a free trade zone, the Trans-Pacific Partnership (TPP), bringing together 12 countries. The main subject of the present analysis is to examine the impact of Donald Trump’s decision of January 2017 to withdraw from the TPP trade agreement on the relations between the remaining signatories of the agreement, as well as to examine Beijing’s actions, which may seek to increase its sphere of influence in Asia through the breakdown of TPP. The main part of the research is focused on the triangle politics concept in international politics, which will include China, Singapore and the United States. Besides the two largest economic powers, Singapore is included because of its membership in the TPP and ASEAN, and due to its strong economy and its population (predominantly) of Chinese origin it can be viewed as the “fifth column” or may otherwise play a role in the Greater China concept. While trauma can be physical, it can also be psychological, social, political, economic, and cultural—encompassing the immediate effects of global pandemics, the ongoing impacts of ethnic and gender bias, the intergenerational legacies of colonization and geopolitical strife, and the planetary ramifications of (...) anthropogenic climate disruption. Ours is an era in which differences of histories, cultures, and identities are engaged as sources of insight, but also one of retrenchment—a period of relational appreciation, but also one of schism. The global scientific community’s response to the COVID-19 pandemic was a stunning example of human potential for empathetic collaboration in the face of global personal and public health trauma. Yet, the economic trauma of the pandemic has resulted in crumbling international alliances, deepening trade wars, and an unfortunate collective reinvestment in zero-sum endgame framings of geopolitics against which there is no vaccination and through which the terms of healing have become delinked from the restoration of global wholeness. These traumas do not stop shaping our lives when the immediate danger comes to an end. Traumatic pain remains stored in the memories of peoples and individuals, it populates their imagination and shapes horizons of possibility. Thus a philosophical exploration of trauma and healing is not only diagnostic of current problems but also a form of genealogy. We invite participants to reflect upon the relational complexity of both trauma and healing, critically and historically engaging concrete occurrences of trauma while also drawing out theoretical insights regarding healing that strengthens and empowers and resists the forms of personal and social amnesia that make the repetition of trauma so tragically common. Of special interest are panels and papers that explore the trauma and healing at all scales from the interpersonal, to the relational traumas experienced by nations at war and cultures in conflict, thus addressing the interplay of the private and public spheres, of ethics and economics, of the human and the natural sciences, and among disciplines, classes, genders, and generations. This article rehearses the critical theory of Craig Calhoun’s book on nationalism and applies his threefold typology of ‘project, discourse, evaluation’ to the peculiar case of modern Philippine nationalism. The Republic of the Philippines is a marine archipelago of over 7100 islands and 85 million people of various ethnic, linguistic and cultural identities. Because of its history of colonizations (Spanish, American, Japanese), the predominance of Christianity, and the lack of a unified or prestigious pre-modern religious, political or economic order, (...) the Philippines is frequently positioned as ‘in but not of Asia’. Because Filipinos are made acutely aware of their peculiar trajectory as a modern nation-state and precarious position within the region, the dominant discourses of ‘the Philippines’ have been too anxious to construct a genealogy of the modern nation-state as telos and to assert some form of ‘Filipino’ identity and spirit. Now that the nationalist moment of contemporary nation-states has passed with the fading of the post-Second World War ‘developmentalist state’ project and its usurpation since the 1980s by ‘the globalization’ project, an opportunity is afforded for a changing of our critical lens from searches for revolutionary projects of founding myths and ends, of romantic nationalisms, or of nostalgic returns to pre-modern idylls (whether ethnic or colonial). Accordingly, this article has three parts. Part One provides a brief synopsis of Calhoun’s arguments about nationalism. Part Two applies these critical insights to the case of Philippine nationalism, especially as it is expressed in the historical and social sciences. Most have noted that there are competing narratives regarding the conceptions of race and ethnicity. Much of the scholarship has been based on social constructivist orientations. The article contributes to the academic discussion on Paulo Freire’s pedagogical thinking as a basis for reinventing contemporary non-formal education. In Finland, Freire’s transformational/liberatory theory of adult learning was applied as a framework for developing an adult educational model called Life Skills for All. The pilot project’s case studies were carried out with different groups of people during the model’s development phase. We describe these cases and discuss what can be learned from them for offering basic and life skills (...) education for adult groups at risk of social disenfranchisement. Our case study analysis highlights some new practices and challenges based on the model’s different applications. We argue that even for basic capacity building of employment skills, it is essential to develop a non-instrumental, holistic, and societal educational approach. Elements for such an approach can be derived from both the Nordic and Freirean traditions of adult education. Also, we suggest that the Life Skills for All model benefits learners’ agency and empowerment by putting the learner at the center, combining the learning of different basic skills, and emphasizing the central role of the local community in participants’ learning activities. Rodolfo Sacco developed the idea of “mute behaviours” during his studies on mute law. The notion of “mute behaviours” denotes an action that is able to mould a legal relationship without any use of language. Certainly, this concept may give rise to some doubts in relation to the attribution—to a behaviour qualified as mute—of the capability to affect dynamics involving a plurality of people. Aiming to clarify the idea of “mute behaviours” by this point of view, the authors analysed the (...) semiotic terminology used by Sacco himself to explain this notion and the issue of its silent nature. Therefore, the terms “signifying signs” and “symptoms”, deemed by Sacco—respectively—incompatible and compatible with the theory of mute behaviours were considered. The former term was traced back to the notion of conventional and arbitrary sign, the notion of the latter was reconstructed linking it to the concept of signs based on signification and suggesting a possible framework in view of the idea of “presentative meanings” developed by the philosopher Guido Morpurgo-Tagliabue. Clarified this dichotomy by a terminological analysis, the authors noticed—as affirmed by Rodolfo Sacco himself—the impossibility to ascribe the notion of gesture to the mute behaviour’s category, as some exegetes proposed. Consequently to this last remark, the authors tried to analyse the relationship between gestures and “mute behaviours”, identifying the category of “sema-pragmatic acts”, that includes gestures and may be seen as an intermediate phase between “mute behaviours” and legally relevant behaviours operated by speaking. This study provides a comparison of thinking style and ethical decision-making patterns between 386 U.S. students and 506 students from the People’s Republic of China enrolled in undergraduate business education in their respective countries. Contrary to our expectations, the Chinese students demonstrated a significantly greater linear thinking style compared to American students. As hypothesized, both Chinese and U.S. students possessing a balanced linear and nonlinear thinking style profile demonstrated greater ethical intent across a series of ethics vignettes. Chinese students (...) also were more likely to adopt an act utilitarian rationale, an ethical philosophy that in practice may violate government regulations or social rules to benefit one’s family instead of society for explaining their decisions across the vignettes. This is what I thought as I watched and shadowed a seasoned interpreter at a world-renowned medical center, during my J-term internship. The fact that I had gotten this opportunity was still hard to believe. There I was, shadowing medical interpreters at one of the best hospitals in the world during my senior year (...) of college after abruptly dropping my secondary education minor to pursue a career in medical interpreting. I felt fortunate for the opportunity and seized the chance to learn from the best of the best.When that same institution hired me after I graduated college in 2006, my training consisted of shadowing other interpreters and having them shadow me. There was no strict process, just one-on-one on-the-job training. The training I received was the best it could be at the time, but not even close to what it takes for an interpreter to become confident and prepared to interpret for most appointments.Growing up I hadn't been interested in the medical profession. When I started working as an interpreter, I soon learned that in addition to my A and B languages, I also needed to learn a C language—the language of medicine. Just as I learned Spanish, I had to learn that a CAT scan was a type of imaging study, and a creatinine level was a measure of kidney function. I was fascinated by the language of medicine. The acronyms, medications, diseases, body parts, hormones, markers, genes, everything.As fascinating as medicine was, it wasn't the reason I considered medical interpreting my calling. As soon as I started working as a volunteer healthcare interpreter at a local free clinic, I knew it was the way I wanted to make a difference in the world. The Spanish speakers I was helping were low-income, underprivileged people with serious medical conditions and a host of other socioeconomic problems. These were people who needed help. These were people who needed to be heard. These were people who needed to be seen. As an interpreter, I would be able to give them a voice. Fast forward 18 years and I am still making a difference in the lives of patients with Limited English Proficient (LEP) by giving them the gift of communicative autonomy, or the right to be in control of and responsible for their own communication.Communicative autonomy is one of the founding principles of the medical interpreting profession. It differentiates the professionals from ad-hoc interpreters and bilingual family and friends. This is because upholding communicative autonomy means that regardless of my personal beliefs, I must remain impartial in all situations. I must interpret what is said and allow all parties involved [End Page 156] to guide the conversation as they see fit. Ideally, I only intervene to mediate for cultural or linguistic reasons when needed.Some of the most ethically conflicting cases I have had to interpret have centered around pregnancy loss and abortion. When I started interpreting, I was a young single woman with a relatively liberal view on reproductive rights. However, one stillbirth and three healthy pregnancies later, my personal beliefs on the subject have become more complicated. Each time I interpret for a loss or induced abortion, I must dig deep and ask myself if I can remain impartial. I can still remember the first time I faced this dilemma.One evening, I was called to interpret for a labor and delivery case. When I arrived, I was informed that it was an induction of an 18-week-gestation fetus that had tested positive for Down syndrome on genetic testing. At the time, I didn't have strong beliefs about abortion. I had never been pregnant and really wasn't sure where I stood on the spectrum of a woman's body, a woman's choice, and abortion is murder. However, there I was, smack dab in the middle of an elective abortion on a weeknight.The bereavement nurse was seasoned and experienced. In bioethical discussions of preimplantation genetic diagnosis and prenatal screening, accusations of eugenics are commonplace, as are counter-claims that talk of eugenics is misleading and unhelpful. This paper asks whether “eugenics talk”, in this context, is legitimate and useful or something to be avoided. It also looks at the extent to which this linguistic question can be answered without first answering relevant substantive moral questions. Its main conclusion is that the best and most non-partisan argument for avoiding eugenics talk is (...) the Autonomy Argument. According to this, eugenics talk per se is not wrong, but there is something wrong with using its emotive power as a means of circumventing people’s critical–rational faculties. The Autonomy Argument does not, however, tell against eugenics talk when such language is used to shock people into critical–rational thought. These conclusions do not depend on unique features of eugenics: similar considerations apply to emotive language throughout bioethics. (shrink)

While the story of Stanislav Petrov – the Soviet Lieutenant Colonel who likely saved the world from nuclear holocaust in 1983 – is often trotted out to advocate for the view that human beings ought to be kept “in the loop” of automated weapons’ responses, I argue that the episode in fact belies this reading. By attending more closely to the features of this event – to Petrov’s professional background, to his familiarity with the warning system, and to his decisions (...) to defy his protocol – it becomes clear that Petrov was not seamlessly working “in his loop,” but reassessing it entirely. I claim that this exhibits a paradox intrinsic to all automated loops: namely, that their optimum function in fact rests on unforeseen human interventions that cannot be reliably codified ex ante, that is, that good judgment cannot simply be “programmed into” their protocols. This dependence, moreover, reveals automation’s ineluctable need for virtue ethics – not in the usual sense (whereby ethics deliberates about, say, possible damages and loss of life), but in the sense that ethical judgment, rightly understood, entails the reassessment of all of the conditions surrounding a decision, including whether a protocol should be followed at all. This very long book sets out to track and trace the working-class men and, less commonly, women who, against the limited expectations of their social position, learned Greek and Latin as an aspiration for personal change. The ideology of the book is clear and welcome: these figures “offer us a new ancestral backstory for a discipline sorely in need of a democratic makeover.” The book's twenty-five chapters explore how classics and class were linked in the educational system of Britain and (...) in its cultural performativity: Is he a gentleman? Does he have Greek? became the paradigmatic questions, as the study of classics became a sign of cultural attainment and social exclusion. This book sets out to explore the counterstory of the cobblers and shepherds who, like Jude the Obscure, fought against society's oppressiveness to access classical learning.The book's breadth is exemplary. It looks at the issue through genres and media, through different communities and national identities, through the prosopography of ragged-trousered philanthropists, beggar-lecturers, body-building performers, and through other institutions and people who helped, including adult-education teachers, kind bosses, supportive vicars, and fiery communists. This breadth, and the fascinating research that it encapsulates, will make this book a fantastic resource for future scholarship: it outlines the richness of a field that has been all too rarely explored properly. If you do not know Stephen Duck, “the thresher poet,” or Hawkie, the crutch-wielding beggar who performed from the books he sold on the streets of Glasgow, then this book is the place to the meet them. The cast list alone is worth the entrance ticket.Yet this very breadth is also the source of the book's limitations. The sheer number of cases listed, treated at similar length and depth, repeatedly conceals the complexity and even the interest of individual figures or events. So, the numerous representations of Vesuvius in shows around London in the first half of the nineteenth century—after the discoveries at Pompeii—are duly noted as a source of excitement and knowledge about antiquity, but against the recent treatment by Clare Pettitt in Serial Forms (which came out the same year) this mere noting looks desperately thin. There is little discussion of how the characters themselves talked about or negotiated class. This deficiency is particularly important for someone like Charles Kingsley, who was very active in the Chartist movement but also became Queen Victoria's chaplain and the professor of history at Cambridge. There are hilarious descriptions of Kingsley's stammering engagement with the working-class leaders he actively supported, which capture how awkward the interaction of classes could be even and especially when the participants shared a goal of transformation. (Ed Richardson's Classical Victorians: Scholars, Scoundrels and Generals in the Pursuit of Antiquity is good on these moments of awkwardness but is one of several books whose absence from the notes looks pointed.) The authors list cases of working men who were picked up by fashionable society as poets or scholars, many of whom were dropped almost as quickly back into penury—but the telling description of such a case in Kingsley's Alton Locke is passed over, although it reveals an acute self-consciousness about such narratives in a best-selling novel.The very structure of the book tends toward listing cases rather than analyzing them in depth. It is not clear why “Shoemaker classicists” should take up a chapter, bar there having been some. Nor is it clear why some figures are not included. John Brown was an uneducated Scottish shepherd who taught himself Greek, Latin, and Hebrew. He was discovered by a professor, one John Pringle, when he went into a shop to buy a secondhand Greek Testament (though his own church thought this newfound and inexplicable linguistic brilliance suspicious or even satanic). Brown went on to write the wonderfully titled The Self-Interpreting Bible, which remained in print and sold very widely for more than a century after its publication in 1778—especially after it was championed by the evangelical preacher Charles Simeon. It is a pity that Brown escaped the authors’ net, but religion, one of the main reasons to learn the classical languages, is downplayed throughout this study, although its imbrication with classics is everywhere in evidence. The book, significantly enough, leads rather toward a rosy-eyed depiction of posh classical communists like Geoffrey de Ste. Croix and George Thompson, and other such heroes of the authors.The authors are much more at home in the years of ardent republicanism in the decades on either side of the turn of the nineteenth century and in the beginning of the twentieth century, when socialism and communism became embedded in British life. The last half of the nineteenth century, when classics really established itself institutionally as a discipline, and its revolutionary potential moved away from the zeal of the Romantic philhellenists into the artistic idealism of a Richard Wagner or the sexual freedom of an Oscar Wilde, are less adequately explored. The huge attendance at art galleries and the Great Exhibition at Crystal Palace as a route to encountering the past of antiquity in material form are barely addressed (Kate Nichols's Greece and Rome at the Crystal Palace would have helped); nor do shows like Astley's Circus get air time (Rachel Bryant Davies's Troy, Carthage, and the Victorians is revealing). It is particularly noticeable in such a voluminous study that there is no discussion of how turning to Greek was a crucial route for the self-understanding of what was considered transgressive male sexuality—and for a particular engagement between the classes. To understand the social force of classics requires a deeper appreciation of the dynamics between conservatism and transformation, disciplinarity and self-discovery. The big picture of how classics matters is lost in the gems picked out by the authors. Gems they are, but their facets need more attention and their setting a broader perspective. (shrink)

Pollution and overuse of resources in China have profound implications for the Chinese people and the world. Globalisation may be partly to blame for this situation, but it is hardly the only explanation. China has been overusing its resources for centuries. Traditional values appear to offer environmentally benign guidance for China's economic development, but they are largely impotent in the face of now-pervasive values manifested in Western-style consumption. Government policies go some way toward addressing this problem, but what may be (...) required is a new set of values that brings self-interest and environmental protection into common cause. This book is designed for three classes of people: Beginners who want an introduction to philosophy; Those who have already had an introduction to philosophy and who would like to see it in action now applied to a great book written by a great philosophy, but who have never read Plato's Republic, the most famous and influential philosophy book ever written; Those who have read Plato's Republic before but did not understand its deepest significance. Why is Plato (...) the best introduction to philosophy? Peter Kreeft has taught philosophy for over 50 years, including one section of a course for beginners every semester. He has tried just about everything possible, and a few new things that are impossible. He has experimented with every one of the many alternative methods available for teaching beginners. (He has A.D.D., so he easily gets bored and likes to try new things all the time.) But he has never found anything nearly as successful as Plato. Plato is the best writer in the history of philosophy. Most philosophers are dull, undramatic, abstract writers. (There are a few other exceptions besides Plato: Augustine, Pascal, Nietzsche, Kierkegaard.) But Plato wrote dramatic dialogues, in which Socrates, his famous teacher, interacts with a great variety of fools. These dialogues are like intellectual swordfights, and even though you know Socrates is going to win, they are exciting because you see his ideas come alive, like a sword in the handoff a master. Plato is a great dramatist, a great poet, and a great psychologist as well as a great philosopher. Nobody else who ever lived combined those four talents as well as Plato did. Apprenticeship to a great master is the best way to learn any art. The student will understand what philosophy is better by watching a master do it than by reading abstract definitions of it from a second-rate philosopher, or by a mere scholar. Concrete examples are always the easiest way to learn things. Plato's dialogues are the world's first, and still the best, concrete example of philosophizing. Kreeft introduces his students to this love affair through a great matchmaker, Plato, who is a better teacher than the student will ever meet in the land of the living. In fact, Plato still is in the land of the living. He's still alive and kicking in his dialogues. He rubs off on those who are wise and humble enough to become a student. (shrink)

The recent advances in assisted reproductive technology, such as hormonal stimulation, IVF, and intracytoplasmic sperm injection (ICSI), have made it possible to circumvent many causes of male and female factor infertility. However, uterine infertility is still considered an ‘‘unconditionally infertile’’ condition. Owing to the continued advances in organ transplantation, microvascular anastomosis techniques, and immunosuppressive medicine, the transplantation of organs is no longer restricted to the ones necessary for continued life. Quality-of-life enhancing types of transplantation, such as uterine transplantation, in recent (...) years, have also entered the clinical arena. This undoubtedly brings new hope to such women, but also creates ethical challenges. Selection of the donor, the impact on the recipient and offspring, as well as challenges to moral and social norms are issues that cannot be ignored. In the present review, the ethical issues of transplantation of the uterus will be discussed in light of recent progress in the procedure. (shrink)

ABSTRACT This article argues that taking concepts of euthanasia out of their political and economic contexts leads to violations of the premises on which the Stoic ideal of euthanasia is based: ‘a quick, gentle and honourable death’.2 For instance, the transplantation of the narrowly defined concept of euthanasia developed under the Dutch welfare system into a developing country, such as the People’s Republic of China (PRC), seems inadequate. For it cannot deal with questions of anxiety about degrading forms of (...) dying and suffering without reference to its economic rationale, demanded by a scarcity (unequal distribution) of health care resources. The weakness of health care provisions for the terminally ill in Mainland China has become increasingly poignant since the collapse of collective health care institutions in the countryside since the reforms of the late‐1980s. As in most cases where health care facilities are wanting, it is difficult to apply the criteria of gentleness and dignity at reaching death. Its solution lies not in a faster relief from suffering by euthanasia, but in extending the quality of life through distributive justice within Chinese healthcare policy‐making. This paper begins with a brief description of the Dutch euthanasia law, after which it discusses Chinese conceptions of euthanasia in biomedical textbooks, the media and in surveys. It concludes by pointing out the need for a transnational framework in which both the specifics and generalities of euthanasia can be discussed. (shrink)

This essay frames the question of responsibility as a problem of agency in relation to the systems and structures of globalization. Responsibility is a “shattered concept” when considered too narrowly as a problem of act, agency, and individual freedom. Constructively, the essay introduces Dietrich Bonhoeffer as the most promising theological dialogue partner for rethinking the meaning of responsibility today. His challenge is to find a way of talking about responsibility that does not collapse into individualism or become ensconced within a (...) univocal logic that subsumes socioeconomic, cultural, and religious differences within itself. The claim is that Bonhoeffer’s reflections on the center, boundaries, and limits of responsibility are helpful today to Christian people struggling with an increasingly exhausted concept of responsibility, when linear agent-act-consequence connections to distant others and far away harms are increasingly difficult to trace. Kant's brief ‘Postscript of a Friend’ serves as a peculiar coda to his life work. The last of Kant's writing to be published during his lifetime, it is both a friendly endorsement of Christian Gottlieb Mielcke's newly competed Lithuanian–German and German–Lithuanian Dictionary and a plea in Kant's own name for the preservation of minority languages, Lithuanian in particular. This support for minority languages has no visible precedent in his earlier writings, in which national, civic and linguistic identities and associated loyalties (...) tend to overlap. Indeed, Kant's understanding of the commonwealth as nation-state seems predicated on the fact or myth of ethnic and linguistic unity and homogeneity. The same apparent lack of precedent also applies to the Nachschrift's singling out as a people of peculiar civic merit of the Lithuanians, who are not otherwise mentioned in any of Kant's published or unpublished writings. The work thus raises an obvious question: why does Kant devote his last published work to a topic and cause in which he does not seem to have taken much earlier interest? (shrink)

The present paper is a response to Gerald Gaus, who has argued that philosophers should not apply ethics. After a critical evaluation of Gaus's arguments, I present several ways which Sidney Hook has outlined for philosophers to bring their skills to bear fruitfully on public policy matters. Following Hook's list, I offer three of my own suggestions for further ways in which philosophers can positively contribute to the application of ethics and of philosophy generally. Finally, I propose the venue of (...) consultancy as a way in which philosophers can begin to use the many skills they have to offer for confronting the problems people face outside of the academy. Constitutional and judicial law-making is increasingly beginning to find its reflection not only in the Anglo-Saxon, but also in the Romano-Germanic legal family. However, the prerequisites for the use of this legal instrument are different, which determines the relevance of conducting a comparative analysis regarding the provision of such a mechanism in the USA and Kazakhstan. The purpose of the research is to identify common and distinctive features in the process of implementation of constitutional and judicial law-making in countries belonging (...) to different legal systems. The article uses the methods of analysis, synthesis, comparison, deduction and generalization. As a result, the specificity of ensuring the mechanism of constitutional law-making in the USA was expressed, taking into account various forms of law-making activity. It has been established that the development of constitutional provisions in the United States takes place with the help of the constitutional doctrines of the Supreme Court of the United States, which provide for the introduction of amendments to constitutional provisions without a formal procedure. As a result of the study of the experience of Kazakhstan, it was established that special priority was given to the role of precedent, in particular, the decision of the Supreme Court of the Republic of Kazakhstan. This is explained by the integrative nature of the Romano-Germanic legal system, which allows effective development of national legislation as a whole and its provisions. The obtained results can be used during the professional training of judges in the Republic of Kazakhstan. (shrink)

The way comparative law methodology is handled by the variety of experiences of normative complexity around the world is, in itself, a stimulating and promising field of research. In particular, the “hybrid” character of the European Union legislation, being juridical and linguistic at the same time, remains the core of comparative law studies, but the dynamic relationship between law and language is constanlty producing ever-changing scenarios, calling for combined scientific approaches. Along with comparative law, semiotics in particular has ensured the (...) proper reading of the complex juridical and linguistic interconnections between the EU legislation and the national courts interpreting and applying them, thanks to its implicit dynamicity and ability to favor the visualization of the real normative semantic flow. By means of a case study, the opening of this “Pandora’s box” will demonstrate that, despite the lack of correspondence among EU categorical and conceptual structure, legal language, court enforcement and spirit of the people (social group), shared contexts of meanings within the EU and the national contexts are already flourishing and become visible when approached from a specifically comparative and semiotics point of view, that's to say as legal _formants_ and as _signs_ and _meta-concepts._.
